Is it illegal to download Movies off of the internet?

Is it illegal to download movies off of the internet (via torrents or BitTorrent)? I am curious because my friend does it and he says that he deletes them after he watches them but I seem to think that that is still illegal. He only says that if you sell it that it would be considered illegal. Is it?

Yes it is illegal, but it is almost impossible to get caught because there are so many people who download.

I’m pretty sure it is. Its like downloading Music off of limewire or something. If youre not paying for it, but your still watching it or listening to it, your technically stealing it.

Its a worse penalty if you sell it. So its taken more seriously.

Suppose you went to a retail store like Walmart and took a DVD off the shelf and went home, opened it, watched the movie, and then returned the disk to its container and put it back on the shelf.

The retail store employee stops you. You say that the DVD is on the shelf and the store can sell it.

Was any crime committed? If so, what crime(s)?

    Only if you get caught!

Whether it is illegal or not depends on many things.

Some movies are released under a license that allows distribution by anyone. The latest Nine Inch Nails album was released under such a license and hence it is completely legal to make a copy for your friend or to download a copy from the internet as long as you follow all the rules in the license.

If the movie you want to download has such a license then it would be legal.

Some countries don’t honour other countries’ copyright laws which means that it is completely legal if you are in one of those countries.

Lastly, the crime being committed is “unlawful distribution”.

This means that uploading without permission is illegal and downloading is not. There are movie services on the internet that allow you to download movies legally because they have permission from the copyright holder to offer this service.

If your friend is using BitTorrent, Limewire or another file sharing network, he will be both uploading and downloading at the same time and he will most certainly NOT have permission to upload from the copyright holder. The lawyers involved in these sorts of cases have also used the “make available” argument which says that even if no one actually connects to your computer and downloads the movie from you, the fact that they COULD HAVE is enough to prosecute you.

No It Is Not At This Point Anyway. The Supreme Court Of Canada Ruled That File Sharing Of Music And Video Is No Different Than Having Photocopiers Beside Copyrighted Books Nationwide. Therefore They Would Not Use The American Style Bully Tactics And Make It Illegal. However With Movie Companies Refusing to Premier Movies In Canada Now Because Of This Look For It To Change
